1.1 These General Terms and Conditions (hereinafter “GTC”) of “Gruftiladen, business owner Alexandra Schnack, Straße der Jugend 18, 14974 Ludwigsfelde, Germany” (hereinafter “Seller”) apply to all contracts concluded between a consumer or business customer (hereinafter “Customer”) and the Seller concerning the goods presented in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is excluded unless expressly agreed otherwise.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor part of an independent professional activity.

1.3 A business customer within the meaning of these GTC is any natural or legal person or legally capable partnership acting in the course of their commercial or self-employed professional activity when concluding a legal transaction.

  1. Conclusion of Contract

2.1 The product listings in the Seller’s online shop do not constitute binding offers but are invitations for the Customer to submit a binding offer.

2.2 The Customer may submit an offer via the online order form integrated into the Seller’s shop. By placing the selected goods or services in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding contractual offer by clicking the button that finalises the order. The Customer may also submit the offer by email or by post.

2.3 The Seller may accept the Customer’s offer within five days by sending an order confirmation in writing or in text form, by delivering the goods, or by requesting payment after the order has been placed.

If more than one of these events occurs, the contract is concluded at the time when the first such event takes place. If the Seller does not accept the offer within this period, the offer is deemed rejected and the Customer is no longer bound by it.

2.4 Where the Customer selects “PayPal Express” as the payment method, submission of the order simultaneously authorises the payment. In this case, the Seller accepts the offer at the moment the Customer initiates the payment process.

2.5 The period for accepting the offer begins on the day following submission by the Customer and ends at the close of the second day thereafter.

2.6 When submitting an offer via the Seller’s online order form, the contract text will be stored by the Seller and sent to the Customer after submission of the order together with these GTC in text form. In addition, the contract text will be archived on the Seller’s website and may be accessed free of charge through the Customer’s password-protected account, provided such an account was created before the order was submitted.

2.7 Before submitting a binding order, the Customer may correct entries at any time using standard keyboard and mouse functions. All entries are displayed again in a confirmation window prior to submission and may also be corrected there.

2.8 Order processing and communication normally take place by email and automated systems. The Customer must ensure that the email address provided is correct and capable of receiving Seller communications, including where spam filters are used.

3.1 Consumers are generally entitled to a statutory right of withdrawal.

3.2 Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party nominated by you, other than the carrier, acquired physical possession of the goods.

Where several goods ordered in one order are delivered separately, the period begins on the day the last item is received.

To exercise your right of withdrawal, you must inform:

by means of a clear statement of your decision to withdraw. You may use the model withdrawal form below, but it is not mandatory.

We will confirm receipt of your withdrawal promptly.

Sending the notice before expiry of the period is sufficient.

Consequences of Withdrawal

If you withdraw, we will reimburse all payments received from you, including delivery costs, except additional costs resulting from your choice of a more expensive delivery option. Reimbursement will be made no later than fourteen days after we receive your notice.

We will use the same payment method unless expressly agreed otherwise.

We may withhold reimbursement until goods are returned or proof of return is provided.

Goods must be returned to the address above within fourteen days. Return shipping costs are borne by you.

You are only liable for diminished value resulting from handling beyond what is necessary to assess the goods.

  1. Prices and Payment Terms

4.1 Prices are final prices plus shipping costs and include statutory VAT.

4.2 Deliveries outside the European Union may incur additional charges such as customs duties or bank fees.

4.3 Payment methods are listed in the online shop.

4.4 Advance payment is due immediately after conclusion.

4.5 PayPal payments are processed via PayPal Europe S.à r.l. et Cie S.C.A. Luxembourg subject to PayPal terms.

4.6 For PayPal direct debit, failed collections caused by incorrect details or insufficient funds may result in bank charges payable by the Customer.

  1. Delivery and Shipping Conditions

5.1 Goods are shipped to the address provided by the Customer or the PayPal address where applicable.

5.2 Failed deliveries attributable to the Customer may be charged.

5.3 Collection in person is not available.

  1. Retention of Title

Ownership remains with the Seller until payment is made in full.

  1. Liability for Defects

7.1 Statutory warranty rights apply.

7.2 Reporting transport damage does not affect legal claims.

  1. Governing Law

German law applies excluding international sales conventions, subject to mandatory consumer protections in the Customer’s country of residence.
